Claims for damages resulting from faulty investment advice are being dealt with by the civil courts.

The Cantons of Aargau, Berne, St. Gallen and Zurich in addition thereto have commercial courts. These professional courts comprise legal experts together with commercial judges. The latter derive from the financial sectors and warrant that complex issues will be correctly evaluated with the help of these practitioners.

The courts do not investigate themselves any faulty advice given. It is down to the plaintiff to submit to the court the decisive facts in detail (breach of contract, damage, causation, blame). It is therefore not sufficient to point to mistakes made while performing the contract by way of example and to hope for the court to draw accurate conclusions and thus to allocate generous damages. Often claims are being rejected due to faulty statements of all particulars.

The hurdle for a structured and logical presentation of the claim sometimes is rather high. Besides, the proceeding of evidence which has to be prepared for by the plaintiff places high requirements. Therefore such civil proceedings are not to be conducted without the help of an experienced litigation lawyer.
